So I've been having major financial problems as of late (mentioned in THIS post). Now usually, when I have financial problems I'm more than willing to own up to them because more often than not, I have made a mistake.
This is not the case this time.
First off, my loan company (ACS Education) was telling me that I had a delinquent fee for not paying my January payment. Which was really odd because I was pretty certain that I HAD paid in January, but when I went to pay my loans online for my February payment, I just went ahead and paid it all thinking that they should know better than I would (which I should have just called them out on to begin with, but alas I didn't). So I paid all my loans and was frustrated by the delinquent fee.
Three days later I found out that my bank account is overdrawn. Guess what, my loan company had taken the money out not once, but twice. So I had over 500 dollars taken out of my bank account in one weekend.
So I called my loan company. They said it was a banking problem. I called my bank, they said it was my loan company's mistake. So I spent over 4 hours on the phone trying to figure out what had happened and how to get it refunded to my bank account. In the mean time, I look at my bank records and suprise suprise, I paid last month's loan payment.
So I was roally ticked.
Now I'm not easily angered, but when you get me mad enough, I have a very volatile temper. I spent the rest of the week battling with ACS trying to get a refund that I deserved. I shouted and I even called an attorney from my church. Basically I was told that I was going to have to wait 45-60 days for a refund. Um, not good enough as far as I was concerned. I finally shouted enough and got a hold of a woman who told me to fax her my bank statement which I did. She told me she'd put it on high priority. Whatever that means. But I wasn't going to get a refund for the delinquent fee that they slapped on me, even though I have proof that they took it out of my bank account last month.
My bank account is so messed up that I got paid today and I'm still overdrawn. My parents gave me a little money to live on until this is all resolved but it's not a lot. I've been the ultimate freeloader and I appreciate all that has been given to me in the last week and a half. My grandparents graciously bought my plane ticket to Orlando that I had budgeted for and wasn't able to get because of this mess. After all this, I'll be in dire need of that cruise.
All this to say, if you've got ACS Education, I would seriously look into changing. They seem very eager to slap on fees when you're delinquent (and even if you're not apparently) and it has been like pulling nails to get a hold of someone that could help me get the money they stole back into my account (and someone who's native language is English; today when I finally got a hold of someone who spoke English fluently I was told that they have an office in Jamaica where most of their calls go, isn't that brilliant?). They were also very adament that it was a mistake on MY part. I finally told the lady on the phone today to just own up to her mistake and stop blaming it on me. It wasn't an error on my part, it was an error on their part. She was more understanding than most of the people I've talked to.
Hopefully it will get resolved quickly. As soon as it does, I'm finding another company to buy my loans. This has been ridiculous and frustrating. I hope no one else has to go through this.

Hey, my mother's been having the exact same problem with ACS. Anyway I could get the number of the woman you spoke to (the one helpful one)? It's been a big source of stress in our house and they don't seem to want to listen to us, our bank, our proof--nothing. Thanks!
ACS screwed up all of my loans and dealing with the customer service has been a nightmare. I wish I would have stuck with Direct Loans to consolidate all of my loans. Anyone who reads this blog should watch out for that company. I am strongly considering legal action to get any kind of movement from ACS. Their rates and internet system are great but customer service is horrible!!
I went through something similar with them as well. Now I graduated college in 2006 and the first 2 companies that had my loan were fine I never had a problem with them. Just this past year I was informed that ACS has bought out my loan and was the company that would be collecting my payments. They have had my loan for less than a year and I already have had a problem with them.
I had to close my bank account due to having unauthorized payments taken out of it by some company, so my bank closed my account for me and I opened a new one. I had to wait 14 days for my new checks and my new bank card. The day I recieved these it was the due date for my loan payment. I immediatly called ACS and gave them my new information and the lady said I would be ok for checkmate II and that I would just have to pay online for July and possibly August. So I said ok and after I spoke with her I went online and made the payment with my new card. 2 days later I recieved an email saying the payment was processed and went through.
Just this past Monday I recieved 2 letters from them in the mail one saying that I was no longer in the Checkmate II program, and another saying that since my payment was not recieved on or before the due date that I was no longer eligable for the special benefits of the consolidation on time program. I was upset and in tears about this.
I called ACS and got some lady that keping telling me I never made the payment and that there was no payment recieved. I told her my situation and that I had paid. She said well why didn't I send a check and I told her because it would not have been on time. So I paid it online. She still proceeded to tell me they never recieved a payment. So I said fine and hung up. She was no sympathetic to my situation.
I went online to the website only to find out that they slapped with me a late fee which made the payment I owed double what I pay a month. I IMMEDEIATLY called them again and got a different lady.
I explained my situation and told the lady I had an email saying I had paid for July 14th on time. She put me on hold for about 10min and then she came back. She apologized and said it was a mistake on their part not mine. I then proceeded to ask will I be put back in the speical benefits on-time program, and she said she would submit a letter seeing if they would do that. I then said no no no you have to put me back in that program because that was your mistake not mine, I shouldn't have to suffer because of your mistake. If I am nto in that program I will be calling again and then getting a lawyer.
My sister is having the same trouble with ACS. They have charged her with late fees, even though she has proof that she paid on time, and some random interest rates that are incorrect, and they refuse to send her the requested monthly statements and how they figured out the interest. She is a math wizard, so she spotted the errors. They agree they made errors, but no one will fix it, or even get back to her.
Stay away from ACS!!!
If anyone else is thinking legal action let me know!
